常见问题
Can a Saskatchewan security guard arrest someone for trespassing?
Not under the Trespass to Property Act. Section 12 gives that arrest power to peace officers. A guard can ask the person to leave and call police. A guard's arrest powers come from section 494 of the Criminal Code.
Can Saskatchewan security guards carry handcuffs or batons?
Only if they are trained in the equipment and the registrar has been notified in writing of the equipment and the duty. Firearms and imitation firearms are never allowed.
How is a trespass notice given in Saskatchewan?
Orally, in writing, or by signs posted so one is clearly visible in daylight from the approach to each ordinary point of access. Some places, such as yard sites, enclosed land and gardens, need no notice at all.
Do I have to report a use of force in Saskatchewan?
Yes. Section 41 of the licensing Act requires a report to the registrar of any incident involving the use of force or another unusual intervention, made on Form E.
